1. Nature of Services

Orchid Education Foundation (“OEF”) provides educational counselling and admission guidance services. OEF acts as an advisory intermediary between students/parents and medical educational institutions. We assist in navigating the admission process — we do not make admission decisions, issue admissions, or guarantee seats at any institution.

2. No Guarantee of Outcomes

While OEF has assisted 2000+ students since 2008, past results do not guarantee future outcomes. Seat availability, fee structures, eligibility criteria, and admission rules change annually and are determined by:

• National Medical Commission (NMC)
• Medical Counselling Committee (MCC)
• State NEET Counselling Authorities
• Individual medical colleges and universities
• NEET UG / NEET PG / NEET SS exam results and cutoffs

OEF bears no responsibility for changes in policy, seat availability, fee revisions, or any decision by an institution or regulatory authority.

3. Fee and Admission Information

Fee information published on this website is sourced from official portals (MCC, State NEET counselling websites) and is provided for general reference only. Actual fees at the time of admission may differ. Students and parents should verify current fee structures directly with the institution before making any financial commitment.

OEF is not responsible for any discrepancy between information published on this website and actual fees charged by institutions.

4. MBBS Abroad Warning

Orchid Education Foundation does not arrange or process MBBS abroad admissions. Information about foreign medical education on this website is published as a cautionary educational resource only. OEF strongly advises students to consult the NMC website (nmc.org.in) directly for current regulations on foreign medical education, FMGE/NExT requirements, and recognised institutions. OEF bears no liability for decisions made regarding foreign medical education.

5. Limitation of Liability

To the maximum extent permitted by applicable law, OEF, its directors, employees, agents, and affiliates shall not be liable for:

• Any direct, indirect, incidental, consequential, or punitive damages arising from use of our services or website
• Loss of admission opportunity, financial loss, or career setback arising from reliance on information provided
• Actions or omissions by educational institutions, regulatory bodies, or exam authorities
• Decisions made by students or parents based on OEF’s guidance
• Any claim arising from security deposit forfeiture at any institution
• Technical errors, website downtime, or data loss

Our liability in any case shall not exceed the service fee actually paid to OEF by the claimant.

6. Independent Verification

Students and parents are strongly advised to independently verify all information, including college recognition status, fee structures, hostel availability, faculty details, and clinical exposure, directly with the institution and with NMC/DCI/CCIM before making any financial commitment or signing any agreement with any institution.

7. No Solicitation of Illegal Activity

OEF does not facilitate, encourage, or participate in any admission process that violates NMC regulations, Supreme Court directives, or any applicable law. NEET UG / NEET PG is mandatory for all MBBS, BDS, and BAMS admissions in India and OEF strictly adheres to this requirement. Any agent or institution claiming MBBS admission without NEET is operating illegally.

PART B — TERMS OF SERVICE

8. Acceptance of Terms

By accessing orchidfoundation.info or contacting OEF for counselling services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please discontinue use of our services.

9. Use of Website

You agree to use this website only for lawful purposes. You must not:

• Submit false or misleading information in any form
• Use automated tools to scrape, harvest, or copy website content
• Attempt to gain unauthorised access to any part of the website
• Use our website or services for any commercial purpose without written consent
• Misrepresent your identity or qualifications

10. Service Agreement

Our counselling services are provided subject to a separate service agreement signed between OEF and the student/parent/guardian. The terms of that agreement govern the specific services, timelines, and fees agreed upon. Free initial counselling carries no fee and no obligation.

Any service fee agreed upon is for OEF’s guidance services only and does not constitute payment of college fees, which are paid directly to the institution. OEF’s service fee is non-refundable once counselling services have been rendered and a seat has been secured as per the agreed terms.

11. Intellectual Property

All content on this website — including text, graphics, logos, design, and code — is the property of Orchid Education Foundation or its licensors and is protected under applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without written permission.

12. Governing Law and Dispute Resolution

These terms are governed by the laws of India. Any dispute arising from use of our services shall be subject to the exclusive jurisdiction of the courts in Guwahati, Assam, India. Both parties agree to attempt resolution through good-faith negotiation before pursuing legal action.

13. Indemnification

You agree to indemnify and hold harmless OEF, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of our services, your violation of these terms, or your violation of any third-party rights.

14. Modifications

OEF reserves the right to modify these Terms of Service at any time. Continued use of our services after changes constitutes acceptance. We encourage you to review this page periodically.
